Last updated: 1 October 2026
Article 1. Applicability
These terms apply to every offer, assignment and agreement between Agroflex Uitzendbureau B.V., hereinafter Agroflex, and a client. Deviations apply only if agreed in writing. The client’s own general terms are expressly rejected.
Article 2. Services
Agroflex provides temporary workers to the client to perform work under the client’s management and supervision. On request Agroflex also provides recruitment and selection, housing and transport of workers.
Agroflex is a member of the NBBU. The NBBU collective labour agreement for temporary workers applies to all placements.
Article 3. Request and placement
In the request the client states the position, the work, the working hours, the expected duration and the applicable employment conditions. Agroflex makes every effort to supply suitable workers but does not guarantee a number or start date unless agreed in writing.
Article 4. Obligations of the client
The client provides a safe working environment in accordance with the Working Conditions Act and informs Agroflex and the worker in advance about the risks of the work. The client treats temporary workers equally to its own employees in comparable positions regarding the conditions covered by the hirer’s remuneration.
The client reports industrial accidents immediately to Agroflex and the competent authorities.
Article 5. Rates and payment
Rates are agreed in writing per assignment and exclude VAT. Changes in collective agreements, legislation or social charges may be passed on in the rate. Invoices are sent weekly based on hours approved by the client and are payable within 14 days.
In case of late payment the client owes the statutory commercial interest and extrajudicial collection costs.
Article 6. Duration and termination
An assignment is entered into for a fixed or indefinite period. An assignment for an indefinite period may be terminated by either party with five working days’ notice, unless agreed otherwise.
Article 7. Taking over workers
If the client wishes to employ a temporary worker directly, it notifies Agroflex in advance. The parties make arrangements in line with the NBBU collective agreement and the applicable order confirmation.
Article 8. Liability
Agroflex is NEN 4400-1 and SNA certified and thereby protects the client as far as possible from hirer and chain liability. Agroflex is not liable for damage caused by a temporary worker to the client or third parties while working under the client’s management and supervision. Agroflex’s liability is in all cases limited to the amount paid out by its insurer in the case concerned.
Article 9. Confidentiality and data
The parties treat each other’s confidential information as confidential. Personal data is processed in accordance with the GDPR and our privacy policy.
Article 10. Applicable law
Dutch law applies to all agreements. Disputes are submitted to the competent court in the district of The Hague.
